Last Friday, 21 July 2023, the ministerial order regulating both the criteria and the certification procedure for emerging companies or startups was published in the BOE.
The National Innovation Company (ENISA), the body designated to assess the status of an emerging company, has already opened the portal to apply for such certification under Law 28/2022 of 21 December on the promotion of the emerging company ecosystem, known as the Startups Act.
Those entrepreneurs who wish to benefit from the advantages and special features of said law must request ENISA to assess their company's status in accordance with the legal criteria, such as the business project, its degree of innovation, the life stage of the company or the personal team, among others.
